Birmingham man charged with capital murder in death of 4-year-old boy

TheBirmingham Police Department reports that detectives have arrested and chargeda suspect in connection with a homicide investigation. The investigation began onSunday, December 16, 2012, at approximately 8:30 p.m., when officers respondedto Children's Hospital Emergency room to investigate a recently deceasedperson. Officers found that Birmingham Fire and Rescue had recently transportedthe victim prior to his death. Hospital staff alerted officers of bruising onvarious parts of the victim's body.

Uponcompletion of the medical examination, the Coroner's office determined that thevictim's manner of death is homicide as a result of his injuries. During thecourse of the investigation, detectives discovered that the boyfriend of thevictim's mother was the person responsible for the injuries on the victim. {}

The victimhas been identified as Jamarion Swinnie, 4, ofBirmingham.

The suspecthas been identified as Robert Lewis Martin, 25, ofBirmingham. ACapital Murder warrant has been obtained against the suspect. The suspect is inthe custody of the Jefferson County Jail.
