Man that used racial slur and slapped toddler on airplane sentenced Monday

Joe Rickey Hundley, former Idaho aerospace executive, accused of using a racial slur and slapping a 19 month old toddler

A former Idaho aerospace executive who pleaded guilty to slapping a crying toddler on a flight is due infederal court for sentencing Monday morning.

JoeRickey Hundley pleaded guilty in October after reaching a plea agreement withfederal prosecutors.

Prosecutorssay Hundley used a racial slur to refer to the 19 month old boy and then hithim under the right eye as the flight from Minneapolis began its descent to theAtlanta airport last February.{} Hundley's attorney said earlier this year that her client was on his way to take his son off life support after being told just 24 hours earlier that he had overdosed on insulin, and was 'upset and grieving' at the time of the incident.

Themisdemeanor simple assault charge carries a possible prison sentence of up to ayear and a fine of up to $100,000. Prosecutors have recommended six months inprison, but Hundley reserved his right to argue for a lower sentence.

The judgeisn't required to follow the recommendations in the plea agreement.
