Murder charge dismissed against dead Shelby County man

A Shelby County man, accused of stabbing his wife to death, will not be taking a murder charge with him to the grave.{} A circuit court judge agreed Tuesday to dismiss a murder charge pending against 87 year old William Virgil Proctor.{} Proctor died December 11, 2013 while in custody at a secure mental hospital.

Proctor was charged with the May 2010 stabbing death of his wife, Gwen Tuggle Proctor, at their home in Pelham.{} When Proctor died in December, a judge was awaiting a report and recommendation from mental health experts on whether he was competent to stand trial.{} Shelby County prosecutors had opposed defense attorneys' requests to have the charges against Proctor dismissed.
