Hoover man allegedly impaired during November car accident, charged with murder

A Hoover man has been charged with murder for the death of a 68-year-old man who died from injuries he sustained in a traffic accident late last year, the Hoover Police Department reports.

Kyle Gavin McCay, 31, is charged with murder and first-degree assault after Hoover Police Traffic Accident Investigators determined he was driving impaired the night of Novermber 24, 2012 when his vehicle hit the driver's side door of the victim's vehicle on John Hawkins Parkway between Hunter Street and Stadium Trace Parkway.

John Ballinger, also of Hoover, suffered serious injuries during the accident that occurred around 7:21 p.m., but he refused medical attention immediately following the crash. His family later took him to St. Vincent's Hospital before being rushed to UAB Hospital where he was pronounced deceased exactly three hours after the crash.

McCay's assault charge stems from the injuries his passenger sustained during the accident.

McCay turned himself into Hoover Police on Wednesday, and he was transferred to the Jefferson County Jail. He is currently being held on bonds totaling $105,000.
