Sen. Rubio: Flynn shouldn't be able to stop investigators from viewing documents

"I don't think Gen. Flynn can invoke the Fifth Amendment for business records, which is what the Senate Intelligence Committee has subpoenaed," Rubio told Sinclair Broadcast Group in an interview Tuesday, May 23, 2017.

Senate Intelligence Committee member Marco Rubio (R-Fla.) says embattled onetime National Security Advisor Michael Flynn has no basis to prevent investigators from seeing certain documents in the probe of Russian-US election interference.

"I don't think Gen. Flynn can invoke the Fifth Amendment for business records, which is what the Senate Intelligence Committee has subpoenaed," Rubio told Sinclair Broadcast Group in an interview Tuesday.

"We're not asking him for his personal notes; we're asking him for the business records of the company that he had."

"I expect that we're going to pursue enforcement of the subpoena; I expect the Justice Department to take it to court, and I expect that the courts will compel him to do it," Rubio said.
